(1st March), I have the honour to report that, I have provisionally appointed Captain Henry George Thomsett R.N., Harbour Master of this Colony, to fill, subject to Her Majesty's pleasure, the temporary vacancy among the official Members of the Legislative Council.
2. It will be seen from the enclosed opinion of the Attorney General, that there is no legal or technical objection to this appointment.

It was not in any way necessary to appoint a temporary official Member for the sake of securing the official majority in the Council, for there is absolutely no opposition to my Government, which is as warmly supported by the Unofficial as by the official element in the Colonial Legislature. My motive was to follow precedents already made in similar cases.
